Blog 5, The FAIRParty and the Constitution, part 1

Originally I was going to make today a family post but decided in the end to keep the focus on the FAIRParty.  There is a lot of material that needs to be gathered for the FAIRParty and I’ll have plenty to write about the family when I start my dengreencpa series. 

THE CONSTITUTION OF THE UNITED STATES OF AMERICA—PREAMBLE 

We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America. 

I don’t think anyone can say it better, this was the intent of our founding fathers.  How did these simple words turning to the huge bureaucracy that we now?  A bureaucracy that is genuinely concerned for our general welfare and will tell us in no uncertainty terms how to accomplish such a thing.  

I’m going to take a look at each Article and Section of the Constitution and see if I can identify the intent and what it has explicitly or implicitly authorized our governments to do for us.  If I am successful these pages will end up in the final product, whatever that is after I receive your contributions and improvements to the party and this writing project.  I plan on doing Podcasts with contributors after I open these pages up for comments so we can discuss either our complementary or opposing ideas before finishing the party platform and writing project. 

Article 1, Section 1.  All laws must originate in Congress, the House and Senate. 

Article 1, Section 2. Members of the House will be elected every two year proportionate to the population of the State they are elected from, minimum age is 25, minimum years a citizen is 7, and they must live in the State they represent.  The members will elect their own Speaker and other Officers and will have the sole Power of Impeachment.  Other detailed rules for filling vacancies and the original number of representatives for the original states, no effect on the FAIRParty.  

Article 1, Section 3.  Members of the Senate will be elected every six years, two from each State with a third of the their terms expiring every two years so the whole Senate is not replaced each six years.  The minimum age for the Senate is 30, with at least 9 years as a citizen, and be living in the State elected from.  Originally Senators were chosen by the State Legislatures but that was changed to popular vote with the Seventeenth Amendment.  The Vice President of the United States is the President of the Senate and has no vote unless breaking a tie vote of the Senate.  The Senate is also responsible for electing a President pro temp ore for when the Vice President is not available and their other Officers.  The Senate will have to sole Power to try all Impeachments and the rest of the Section provides more details on such. 

There are 10 sections to Article 1 and we will continue in this vein tomorrow, now off to home and finishing my son’s tax return, so looking forward to the FAIRTax.  With all my Love, Dennis
